1. Who are we?
Triggerz Design Studio, registered at Van Sonsbeecklaan 1A, 6191 JL Beek (The Netherlands), with the Dutch Chamber of Commerce under number 82739897. Phone +31 46 207 6023, e-mail info@triggerz.eu.
2. Applicability
These terms apply to all quotes, assignments and agreements with Triggerz Design Studio, unless we've explicitly agreed otherwise in writing. The client's own general terms do not apply, unless we've expressly accepted them in writing.
3. Our services
Triggerz delivers digital services, including:
- Web design and web development (websites, web shops, custom applications)
- SEO, Google Ads (SEA) and link building
- Social media management and advertising
- Branding, logo design and graphic design
- Audiovisual production (photo and video)
- Web hosting and domain registration
In principle we do not deliver physical products. Print work and printed production are arranged in partnership with external printers; responsibility for the actual production, delivery and quality of physical goods lies with the printer. We guide the process and supply print-ready files.
4. Quotes and agreements
A Triggerz quote is valid for 30 days, unless stated otherwise. An agreement is formed when the client accepts the quote in writing (by e-mail or signature) or when we start execution based on a verbal or digital instruction. Scope changes are confirmed by e-mail and may impact price and planning.
5. Lead time
For a standard business website we use an indicative lead time of four weeks, counted from the moment all required content (texts, imagery, credentials) has been delivered by the client.
Important note from practice: in reality this regularly stretches to six to eight weeks. The most common causes:
- Delay in content delivery by the client (texts, photos, logos, product information)
- Feedback rounds requiring more iterations than initially anticipated
- Changes in scope or direction during the project
- External dependencies (printers, external developers, API integrations, connections with accounting or inventory systems)
We communicate in good time when a deadline is likely to slip, with an explanation of the cause. Lead times are target dates, not fatal deadlines, unless we've agreed otherwise in writing. An indicative lead time does not give grounds for compensation or termination of the agreement.
6. Payment terms
Our standard payment structure:
- Deposit: 50% of the project amount upon signing or acceptance of the quote
- Final invoice: 50% upon delivery and go-live
- Maintenance invoices: monthly, paid in advance
- Payment term: 14 days after invoice date
For late payment we charge the statutory commercial interest plus €40 administration fees per reminder. Any collection costs are entirely for the client's account.
Retention of title: delivered works (websites, designs, source code, content) only become the client's property after full settlement of all outstanding invoices.
7. Maintenance contracts
Maintenance contracts (websites, hosting, social media management) are cancellable monthly at the end of the calendar month, by e-mail to info@triggerz.eu. We do not guarantee specific uptime percentages or response times unless this is separately agreed in writing in a Service Level Agreement (SLA). Of course we aim for maximum availability and do everything we can to solve issues quickly.
8. Intellectual property
Until full payment, all creative works — designs, logos, source code, texts, videos and photos that we've produced — remain the property of Triggerz Design Studio. After full payment, the client receives usage rights for the agreed purpose.
Triggerz retains the right to display delivered work in its portfolio, on its website, in case studies and on social media, unless the client objects in writing with reasons (for example for confidential projects). Source files (PSD, AI, Figma, project files) are not delivered by default; these are available on request for an additional fee.
9. Liability
Triggerz Design Studio is not liable for:
- Indirect damages, lost profits, lost revenue or reputational harm
- Damages caused by errors of third parties (printers, hosting providers, external APIs, payment providers)
- Damages caused by incorrect, incomplete or late content supplied by the client
- Damages caused by changes made by the client or third parties after delivery
- Unavailability due to force majeure (power outage, internet outage, DDoS, fire)
Our total liability is in all cases limited to the invoice amount of the specific assignment from which the damage arises, capped at the amount invoiced to us in the six months preceding the damaging event.
10. Confidentiality
All business information, strategies, client data and financial information we receive from the client is treated confidentially. We do not share specific client data with competitors or third parties, unless this is necessary for the execution of the assignment (such as hosting providers or printers) and only as far as required.
11. Changes to these terms
We may amend these general terms. Existing agreements remain governed by the version that was valid at the time of signing or acceptance of the quote. New agreements fall under the then-current version.
12. Applicable law and disputes
All agreements with Triggerz Design Studio are governed by Dutch law. We first try to resolve disputes amicably — most of the time that works. Should we fail to agree, the District Court of Limburg (location Maastricht) has exclusive jurisdiction to rule on the dispute.
